Terms and Conditions

Your booking confirms acceptance of these conditions – please read them carefully

1) Contract

This is between the person whose details are specified in the booking form (‘you’) and Christopher Cairns, the owner of The Cabin (‘the property’). This contract becomes effective in accordance with its terms when you complete the booking form. You confirm that you and all persons staying at the property will be bound by these terms and conditions and that you are responsible for all persons staying at the property during the period of hire. Sub-letting is prohibited. You must be over 21 years of age.

2) Period of Hire

The property is let on a weekly basis from Saturday to Saturday, 3pm on the date of arrival until 10am on the date of departure. In certain weeks, the property may be let on a ‘short break’ basis on such terms as may be specified. The times of arrival and departure are as above (but maybe subject to change by the owner to permit altered cleaning requirements).

3) Booking / payment

You can book the property and make payment at any time online by credit/debit card via Pay Pal. You may also pay by cheque drawn on a UK bank account. The deposit is payable by you when you make the booking and the balance of the hire charges plus the good housekeeping deposit are payable by the date which is no later than six weeks prior to your scheduled arrival date. The sums payable for rental of the property (‘hire charges’)  and the address to which cheques may be sent are set out in the website. The good housekeeping deposit is refundable as set out below. 

4) Deposit / balance of charges / confirmed booking

A deposit of 30% of the hire charges is payable on booking. The balance of the hire charges plus the good housekeeping deposit are payable no later than six weeks before your scheduled date of arrival. Payment of the full hire charges plus the good housekeeping deposit is required on booking if the start of the rental period is less than six weeks from the date of booking.

If the balance of hire charges plus the good housekeeping deposit is not received by the due date (six weeks prior to your holiday) and you do not contact the owner to make a cancellation prior to that date (see paragraph 6 below) then the owner will be entitled to re-let the property and the deposit will be forfeited by you. You will also be liable for the balance of the hire charges.

A reservation only becomes a confirmed booking when payment is received by the owner in cleared funds of the deposit (or the full hire charges plus the good housekeeping deposit where the start of the rental period is within six weeks of the date of booking.) 

5) Good Housekeeping Deposit

The good housekeeping deposit of £150.00 is payable at the time set out under paragraph 4 above. This deposit will be banked in a non-interest bearing account and will be returned to you within 10 working days of the end of the rental period less any deductions for any loss suffered by the owner as a result of breach of this contract by you or any member of your party or as a result of a requirement for extra cleaning (beyond five hours), or for costs incurred for repairs or replacements due to breakages or damage. If this deposit is insufficient to cover the above, the owner reserves the right to require you to pay additional sums and you agree to do so within seven days of notification by the owner. The good housekeeping deposit or any portion of it which is refundable will be sent to you at the address on the booking form by cheque if you have paid by cheque or credited to your credit card, or paid into you account by bank transfer, should you request this.

6) Non-Payment / Cancellation

Should you need to cancel your holiday, you must contact the owner immediately.

If you cancel prior to six weeks before your scheduled date of arrival, the owner will try to re-let the property on the website. If he is successful in re-letting the property for your full rental period, all monies paid by you will be refunded. If he is not able to re-let the property for your full rental period, you will forfeit the deposit. If you have already paid the balance, however, this will be refunded to you.

If you cancel within six weeks of your scheduled date of arrival, the owner will try to re-let the property on the website for your full rental period. If he is successful, all monies paid by you will be refunded. If he is not able to re-let the property you will forfeit all monies paid. If he is able only to re-let part of your scheduled dates, you will forfeit any shortfall.
It is recommended that you take out holiday/travel insurance.

7) Occupancy

The number of persons occupying the property must not exceed four. If the maximum number is exceeded, you and members of your party may be required to vacate the property immediately. You will not be entitled to any refund of hire charges.

8) Telephone Charges

A telephone is provided at no extra cost. However, we ask that you use it responsibly for necessary calls only. We reserve the right to charge you, following your departure, for any excessive telephone use. 

9) Household Instructions

You must comply with the specific instructions in relation to the property and its contents provided to you on arrival at the property and by email. 

10) Complaints and Problems

Should there be any problem or cause for complaint, please contact the owner as soon as possible on the telephone numbers provided.

11) Breakage or Damage

For the benefit of future holidaymakers at the property, you must advise the owner of any breakage or damage that occurs during your stay.

12) Care of Property

You are not required to clean the house on departure but you must take reasonable and proper care of the property and its contents and leave them in a clean and tidy condition. 

13) Smoking

The property is non-smoking.

14) Pets

Unfortunately, no pets are permitted.

15) Right of Entry

The owner reserves the right of entry at all reasonable times for the purposes of inspection or to carry out repairs or maintenance.

16) Repairs to the Property

Due to wear and tear, an aspect of the property or its contents may be damaged or not working. While we will do our best to carry out repairs as quickly as possible, you acknowledge that this may not be achieved within a short time frame due to the location of the property.
We will try to schedule any repair or maintenance work for changeover days or other times when the house in unoccupied. However, if this is not possible and work needs to be carried out when you are in residence, you will allow access for the relevant trades person or contractor. 

17) Roof

At no time is it permitted to access the turf roof. Children must be supervised at all times.

18) Right of Termination

The owner reserves the right to refuse access to the property at any time to you and your party if, in his opinion, you are not suitable to take charge of the property. If this occurs before the rental period starts all monies will be refunded and this contract terminated without further liability. The owner reserves the right to terminate this contract at any time or remove any person or persons due to unreasonable behaviour, damage to property, or exceeding the stated occupancy. In this case, any refund is at the sole discretion of the owner.

19) Availability

If the property cannot be made available by the owner for any reason for all or part of the rental period due to events beyond the owner’s control (including in connection with Covid-19) and the owner is forced to cancel the booking, all sums paid will be refunded and you will have no further claims against the owner. You are advised to take out a holiday cancellation insurance policy.

20) Adverse Conditions

If the property is inaccessible due to bad weather conditions or if for any reason there are transport disruptions or road closures the owner cannot be responsible for non or late arrival and no refunds will be given. You are recommended to take out holiday/travel insurance. 

It is possible that the driveway leading to the property may become icy or be covered in snow in winter. In such circumstances it is advised that your car(s) should be parked at the top of the driveway off the road. Should you elect to drive down to the parking area this is entirely at your own risk.

21) Liability

The owner has no liability for any death, personal injury, damage or loss of any nature whatsoever (including to motor vehicles and personal belongings) unless this is as a result of the owner’s own negligence.

22) Covid-19 Provisions

If for any reason, you or any member of your party (a ‘remaining guest’) does not vacate the property on the due date of departure for any reason (including ill health or self-isolation as a result of Covid-19) you must inform the owner of the reasons immediately and advise of the intended date of departure. In such circumstances additional rent will be due by you and you are advised to take out appropriate travel/holiday insurance. The additional rent will be calculated by the owner based on the weekly rental rates for the property and the additional time period any remaining guest is in the property. If any remaining guest vacates the property during a week when the property has been rented to another party, you will be liable for the full week. The additional rent will be payable by you within seven days of notification of the amount by the owner. The owner may elect to inform you of the additional rent on a week-by-week basis such that additional rent may become payable more than once or to notify you of the additional rent only once when any remaining guest has vacated the property.

You are obliged to inform the owner as soon as possible if any member of your party displays syptoms of Covid-19 within14 days of vacating the property.

23) Governing law / Jurisdiction

This contract is governed by Scots law and the parties submit to the exclusive jurisdiction of the Scottish Courts.
